The Hard Road - Post 7

Put yourself in the shoes of a judge who is the one deciding the guilt or innocence of Jennifer Porter. Explain what you would decide and why this is the case. In addition, provide your sentencing for Porter if you have found her to be guilty of anything.

    I would agree with Cohen, that Porter wasn’t in her right mind when and after she hit the children. She said multiple times that she didn’t remember hitting anyone but she does remember a body hitting her windshield. Her family and friends all said that she was a good person. I thought that it was obvious that she was affected by the whole accident in her mug shot and the way that she carried herself after. I think she was traumatized and doesn’t need prison on top of it all because she doesn’t deserve it and it would just make it worse for her. I believe if she was in her right mind she wouldn’t have left the scene.

    If I was the judge, I don’t think I would have punished Porter. It was clear to me that Lisa Wilkins was hurting, but had forgiven Porter. I think the case should have ended there. It’s obvious that the case went on too long. I would have cut it halfway and not punished Porter. I don’t think that Porter needed to be on house arrest for that long, or be on probation for very long either. 500 hours of community service seems fair enough by itself. However, it’s the jury that finds the people guilty, the judge just keeps order over the court.

    I think that Jennifer didn’t deserve jail time, if I was the judge I would find her innocent because she wasn’t the first person to hit the children. I don’t think that she was able to think or decide to go back to the scene ethically because it was her instinct to go home and hide. She seems extremely remorseful and it wasn’t something she meant to do.

    If I were in the shoes of Judge Emmett Lamar, I would have most definitely given a more harsh consequence to Jennifer Porter. She was guilty; there was no doubt about that. I realize she did not do this on purpose, but she was not being a responsible driver. There were signs of the crosswalk prior to the accident, her headlights were not on and she was driving a good 10-15 mph above the speed limit. I understand why she fled the scene, and I realize that she was scared of what was to come, but neither of that changed what she did. She killed two children. Yes, it was an accident. But accidents can only be excused so much; a line has to be drawn. Jennifer Porter deserved at least some jail time, AS WELL AS the two years of community control, the three years of probation and the 500 hours of community service that was already given to her.

    I agree with Jess that Porter doesn't deserve jail time, but i disagree that she wasn't the first person to hit the children because it was never proven. I also agree that she seems like she feels sorry and that she didn't mean to do it.
